Conflicto de competencia entre el Juzgado Segundo Civil Municipal de Rionegro (Antioquia) y el Juzgado Dieciocho Penal Municipal de Medellín con Funciones de Control de Garantías, en torno al trámite de la acción de tutela de la referencia.
Se dirime el asunto ordenando la remisión del expediente al Juzgado del municipio de Rionegro, para que de forma inmediata le imparta el trámite de primera instancia que corresponde y profiera decisión de fondo respecto del amparo solicitado, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.

- PRIMERO. DEJAR SIN EFECTOS el Auto de 25 de mayo de 2015, por el cual el Juzgado 2º Civil Municipal de Rionegro -Antioquia- rechazó de plano la acción de tutela formulada por el señor César Andrés Moncanut Gaviria en contra de la Secretaría de Hacienda del municipio de Rionegro -Antioquia-.
- SEGUNDO. DEJAR SIN EFECTOS el Auto de 9 de junio de 2015, por el cual el Juzgado 2º Civil Municipal de Rionegro -Antioquia- propuso el conflicto negativo de competencia y ordenó remitir las diligencias al Consejo Seccional de la Judicatura con sede en Medellín.
- TERCERO. Por Secretaría General, REMÍTASE al Juzgado 2º Civil Municipal de Rionegro -Antioquia- el expediente contentivo de la acción de tutela instaurada por el señor César Andrés Moncanut Gaviria en contra de la Secretaría de Hacienda del municipio de Rionegro -Antioquia-, para que, sin más demora, proceda a impartirle el trámite de la primera instancia y profiera decisión de fondo respecto del amparo solicitado.
- CUARTO. Por Secretaría General, COMUNÍQUESE la decisión adoptada en esta providencia a las partes y al Juzgado 18 Penal Municipal de Medellín con Funciones de Control de Garantías.
